Terms and Conditions

These terms and conditions (the “Terms”) govern your use of the services offered by BE AT HOME, including the listing and rental of real estate properties, hotel bookings, and rental management services (the “Services”). By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Services.

1. Description of Services. BE AT HOME offers a platform for users to list and rent real estate properties, book hotel accommodations, and manage rental properties. The Services may be used by individuals, property owners, and property management companies. BE AT HOME does not own or operate any of the properties listed on the platform, and is not responsible for the condition or suitability of any listed property. It is the responsibility of the property owner or manager to ensure that all listed properties meet applicable laws and regulations.
2. Disclaimer of Warranties. BE AT HOME does not guarantee the accuracy or completeness of the information provided on the platform or through the Services. The Services are provided “as is” and “as available,” and BE AT HOME makes no representations or warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
3. Limitation of Liability. In no event shall BE AT HOME be liable for any damages of any kind, including but not limited to direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use of the Services or the inability to use the Services. This limitation of liability shall apply even if BE AT HOME has been advised of the possibility of such damages.
4. Indemnification. You agree to indemnify and hold BE AT HOME and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.
5. Choice of Law. These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Republic of Kenya, without giving effect to any principles of conflicts of law.
6. Arbitration. Any dispute arising out of or in connection with these Terms or the Services shall be resolved through binding arbitration in accordance with the International Centre for Dispute Resolution Rules of the International Chamber of Commerce. The arbitration shall be conducted in Nairobi, Kenya.
7. Class Action Waiver. You agree to waive your right to bring or participate in any class action lawsuit against BE AT HOME.
8. Entire Agreement. These Terms constitute the entire agreement between you and BE AT HOME and supersede any prior agreements or understandings, whether written or oral.
9. Modification of Terms. BE AT HOME reserves the right to modify these Terms at any time, and it is your responsibility to check the Terms periodically for updates. Your continued use of the Services after any modification of the Terms shall be deemed to be your acceptance of the modified Terms.
